Probation is a jail sentence that the Court allows a person to serve outside of jail as long as certain rules and conditions are followed. If you violate the terms and conditions of your probation, a Probation Officer has the ability to incarcerate you until a hearing takes place in front of the Judge that ordered the initial sentence. It is not uncommon for a person on probation who is arrested to spend months in jail before getting an opportunity to be heard by the Judge.

At a probation revocation hearing, the Judge has the authority to order further incarceration, revoke First Offender status, or order further special conditions of probation.
